Forest & Tree Clearing
A Chesapeake Bay Critical Area (CBCA) goal
is to maintain forest coverage in all land use designations. Forest
that is removed for development in the CBCA must be replaced, or a
fee-in-lieu of $0.40 per square foot must be paid so that trees may be
planted elsewhere in the CBCA.
In the IDA, LDA and RCA, no more
than 30% of the forest cover on a given property may be cleared for
development. Clearing of 20% or less of the property’s forest cover
requires replacement of that forested area on a 1 to 1 basis, or payment
of a fee in lieu. Clearing of more than 20% of the forest cover
requires replacement of a forested area of 1.5 times the area of forest
cleared, or an equivalent fee in lieu. Replanted forest must have at
least 400 seedlings/saplings per acre.
