POWER OF ATTORNEY

A Power of Attorney is used most frequently to allow a friend or family member to assist an aging parent with "paper work" and financial affairs. Health care decision making can be included in the financial Power of Attorney, or can be drawn up as a separate Power of Attorney specifically for health care. The Power of Attorney will be terminated when the parent dies, and or if the parent becomes incompetent, unless it is a "durable" Power of Attorney in which competent, that the document should remain valid in the event of his or her incompetence. A Power of Attorney can be written to take effect immediately or upon the parent's disability (a "springing" Power of Attorney).
